When direct negotiations between attorneys for the parties do not yield a settlement in a court case, voluntary mediation by a neutral third party may provide a viable alternative. Resolving disputes sooner rather than later is often advantageous for the parties from the standpoint of both costs and stress. Pressing forward with litigation also does not provide a guarantee of winning for either party — adverse decisions by judges and juries can come completely unexpectedly. In addition, courts often express a preference for parties to resolve matters themselves. For all these reasons, mediation may provide a beneficial way for parties to find a mutually agreeable solution that brings litigation to an end.
